Do Fine Art America Share Your Work With Other Companies

I've discovered this today:

One of my images being sold by a company called SuperOxy Shopping Mall. I've never licensed my image to them, I've no idea how they could've got the image at a saleable size. Are they a company owned by Fine Art America / Pixels? I can send them a cease and desist but I just wanted to check first.

There are a handful of brick and mortar shops FAA sells through IF you are signed up, but that shop is not one of them.

They do have a handful of other stores, but they always look like this store. And that store is only selling that image for $2. Which is impossibly low.

Now if you have the license set up here, I don't know if they tell you who the company is, but I doubt they would make a profit on $2. The site has a base markup that is well above that. So I would say they took the image and are selling it for a low price and I would have them remove it.

Great there are a bunch of mine up there too...

i'll see if the other one works. I just grouped it all up from the search and said remove it in a legally threatening sounding way, rounding off what chatgpt said while leaving off my personal stuff because they really don't need to know that.

Its weird how all the products don't mention what they are buying, the size, or anything else. Just a lot of really random prices.

They have one of my works. Found a working e-mail addy to report this website.

I checked the resource link Abbie provided in her first post. Reading it I went to the Hostchecker site which listed the webhost is listed as Cloudflare. https://fineartamerica.com/showmessages.php?messageid=6728410 resource link says if it is Cloudflare then go to ---> I went to https://abuse.cloudflare.com/ and then filled out the report ( if there is multiple works you can put up to 200 direct links to the infringing work). I got a response back from Cloudflare on who the webhost ISP provider is with a link to report it to their abuse department to get the infringing works removed. Cloudflare also sent a copy of my report to the webhost provider about the infringing work.

Thank you Abbie for the Resource Info. And if the blocking the hotlinking works that would be wonderful as well.

Update: Ok, not sure if I want to proceed with directly reporting to the webhost which Cloudflare listed as Slobozhenyuk B.Y. PE which says it is in Ukraine.... so the Infringing website lists an address in the U.S. with the owners name but their Webhost is in the Ukraine...

I don't think anyone will have any success in contacting SuperOxy. I just found this YouTube Video saying the site itself is a scam. So most likely there's no way to get them to take down your work by contacting them. The YouTube video is short. https://www.youtube.com/watch?v=6rA7I5aMShU

Point to note: t's always a good idea to pass any links through your virus program to ensure you are not clicking on a malicious website.

Absolutely! You already know these guys are scammers, why in the world would you ever think it would be a good idea to go to their site? If you simply can't help yourself, at least use an iDevice to do it. If you've already been there, run a scan.

So, in summary, just another scam site. No point trying to contact them. As for your own images 'being sold' elsewhere, not much can be done about it. Their site is probably one of thousands selling stuff that isn't theirs. With AI / bots / spiders this is something that is all too common now and there's no way the genie is going back in that bottle.
Going back to my original I was probably just a bit peeved that my solitary piece was in their bargain bin :)

If you can find a way to find who is hosting the site maybe. I tried, it seems like its connected to one place that's connected to another and so on. The only people who will be scammed are confused customers thinking they are getting a great bargain. Doubt they will get anything. Hope they don't yell at me because I will tell them they were scammed and i'm not associated with that site.

Everything in that store is in their bargain bin.

I trust my bit defender to block the sites that are a threat and I got no warnings. Just to be safe I will run a MWB scan to quarantine anything questionable but BD usually doesn't need any backup from MWB.

As far as I know that site doesn't have viruses, some of their other sites they have didn't load at all, so those were blocked. I just wish there was a way to get them removed. I don't think they sell viruses, I think they just scam people from their money. I'm willing to bet you can pay just fine on that site. Too bad you can't get through to find out when your thing is coming. But if they are sending something, what do they get? And what is authenticity guaranteed, that doesn't even make sense.

I'd just like to point out that the real purpose of these sites can be to infect visitors with malware, not sell images. IMHO, best to completely ignore them and not waste time with the DMCA, which is close to worthless.

Agree with you Jim, especially since my AV blocked the pages on that site as a threat.

I ran a malwarebytes scan and didn't find anything but ya'll still need to proceed with caution. Like Mike, I could find no way to actually contact anyone about DMCA takedowns.

If you search hard enough for scammers you will fall right into their trap. You said you discovered your images. Well how did you discover them? Perhaps the process of searching led you to see your work. Learn to recognize the difference between an actual use of your image and a malware trap. I agree with what Jim said and these sites will always be there and DMCA orders are useless.
