Can I Use A Gnome Statue I Have As A Character For A Comic?

Hello, I have bought a gnome statue from 'BigMouth Inc.' and am planning to create a comic of gnomes based on this gnome, BUT I also want to create full-page realistic and more detailed drawing of this statue I bought (I will replace textures and add a background) with colored pencils and use them in this comic, so, for example, the first 3 pages are conversations and stories then add this big drawing I will make related to the previous three pages... Am I allowed to do this? As all gnomes look the same, I will change the clothing and accessories, just copy the position and body structure... Btw, I am going to send them an email, but I want an opinion from here first...

you will have to check for yourself that this gnome and the general concept of gnomes isn't copyrighted to someone else already. chances are, if it looks just like that one - then its copyrighted. the body position should be fine. i would ask them really - only. we can only guess.

This link doesn't directly answer your question but it speaks to how they view their designs and how they protect them. That said I'm thinking they aren't going to go for this unless there is something in it for them. Their gnomes look pretty unique to me. They are already licensing many products to compliment their own so I would expect any deal you work out is going to require some sort of licensing payed to them.

Draw your own would be my suggestion... if you start making money at it you don't want someone coming out of the woodwork accusing you of stealing their gnome.

I should imagine no is the answer.

I would contact the actual creator (not the store) and get permission
