Honored, But I Don't Know What To Do... :)

Hi,

I have a photo I took in Kingman, Arizona of this Jack Rabbit sculpture by artist in residence Donald Gialanella.

If it's really the artist, I'm honored to the sky of course, and I would give him the photo for free...

But, I'd like to see some opinions on what would you do, please?

I would give him the image for free since he is the sculptor. It's a good idea to cultivate connections with other artists, I think.

Congrats,deserved,and, why not approach him about his honouring your photo,
especially, both being artists, that he perhaps, publish a link to your photo on
his websites , incl the image? No harm in asking, is my answer to your question..

Just a question, can you even legally sell that as it is his artwork and he obviously isn't dead 75 years yet?

Of course, allow him to use this image, but ask if he would also give you a photo credit/link to your image on FAA,

Rose, I read something that said it is ok to do so if the sculpture is permanently on display in a public place, such as a park or street.

Yes sure, the next step is to ask if he would give me a credit on his site... if not (and even if he will) I'll advertise this myself on the FAA description, my blog and SM :)

About selling it, yes I'm sure that it's legal, since I posted the artist name (and obviously he's not against this), and since as Corinne said, it's in a public place and not an isolated image per se.

Throughout all my years creating sculptures, I've found many times my work photographed and posted on the internet.

Generally, after contacting them, we come to an agreement

They're free to sell their photos as long as I'm credited for the work photographed

With the caveat that I can use the images for publicity whenever I feel appropriate, giving the photographer credit for the photo.


At times, it happens that unsolicited photos of me at work (at shows) are posted for sale.

The same agreement was made in this case.

Roger you are very nice to allow it. Most people dont ask the artist before they post it for sale.

I had a conversation about the statue in Winslow on route 66. Both the artist and the sculptor gave permission but the sculptor said he maybe entering into an exclusive deal and then he will request all images of his standing on the corner will have to come down.

It's always good to ask to be sure
